License suspensions

Your license is its own case, on its own clock

A suspension can start at the roadside, before any court date. The hearing that can stop or shorten it has to be asked for quickly.

When you're charged after a stop, the motor vehicle agency can suspend your license on its own track, separate from the criminal case. The notice you were handed or mailed gives the reason and a short deadline to ask for a hearing. Miss it, and the suspension usually runs without anyone hearing your side.

At the hearing I question the paperwork behind the suspension and, where it fits, ask for a hardship license so you can still get to work, school or a doctor.

How a suspension case usually runs

  • 01

    The notice

You're handed or mailed a notice of suspension. It names the reason and the deadline to respond.

  • 02

    The request

We ask for a hearing in writing, inside the window on the notice.

  • 03

    The hearing

A hearing officer reviews the stop, the test or refusal, and the paperwork. I'm there with you.

  • 04

    The decision

The suspension is upheld, shortened or set aside, and we talk about a hardship license if one applies.

Suspension questions

Can I drive while I wait for the hearing?

Sometimes. It depends on the kind of suspension and the dates on your notice. I'll tell you exactly where you stand once I've read it.

What is a hardship license?

A limited license for set hours and purposes, such as work. Not everyone qualifies, and the rules depend on your record and the reason for the suspension.

I'm licensed in another state. Does this affect my home license?

It can. States share records, and your home state may act on a suspension here. We plan for both.
